Cerebral Palsy / Erb’s Palsy

All parents hope for a smooth labor and delivery and a healthy baby. But when the negligence of an OB/GYN or other health care provider leads to a birth injury such as cerebral palsy or Erb's palsy, parents may not know where to turn.

I am attorney Valerie Leopold, and I have been helping parents dealing with the aftermath of a serious birth injury for more than 30 years. To schedule a free consultation with a Chicago cerebral palsy and Erb's palsy injury lawyer, please contact my law firm online.

Cerebral Palsy Guidance

"Cerebral palsy" refers to a group of disorders that can be caused by oxygen deprivation to the brain, damage to the developing brain, and abnormal fetal development. Signs and symptoms of cerebral palsy vary widely, but can include involuntary movement, posture abnormality, muscle stiffness, delayed sitting or crawling, and difficulty with fine motor tasks.

Negligence during labor and delivery can cause an otherwise healthy baby to develop cerebral palsy. Physicians and other health care providers are expected to monitor for signs of fetal distress and take action to avoid an injury resulting in cerebral palsy or another birth injury.

If your baby was injured during or shortly after labor and delivery, you should talk to an experienced medical malpractice attorney about your legal options. It can be difficult to prove that medical negligence caused or contributed to your baby's injury. Talk to a trusted legal advocate who can help you take the steps needed to prove that medical negligence caused your baby to develop cerebral palsy.

Erb's Palsy

Erb's palsy (also known as shoulder dystocia) is a condition caused by damage to the nerves in the brachial plexus in the shoulder area. Signs and symptoms of Erb's palsy include weakness, limpness, or paralysis in the arm, difficulty gripping with the hand, lack of sensation in the hand, or general difficulty with arm or hand movement.

Erb's palsy is a preventable condition that is primarily caused by trauma to the baby during labor and delivery. Doctors should monitor the mother for possible indicators of a difficult delivery that could lead to Erb's palsy. If you believe your child's injury was caused by medical negligence, talk to a lawyer about your legal options.
